Terms of Service

1. Acceptance of Terms

By creating an account or using NicoleAI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by FREE YOUR MIND LLC ("Company," "we," "us"). These Terms form a binding agreement between you and FREE YOUR MIND LLC.

2. Description of Services

NicoleAI is an AI-powered coaching and copywriting assistant trained on content, coaching, and voice materials from Nicole Brennan. The Service provides:

• Conversational AI coaching sessions
• Copy review and feedback ("Copy Coach Mode")
• On-demand mindset and confidence support ("Pep Talk Mode")
• Saved conversations, copy vault, and user profile

The Service is provided "as is" and we may add, remove, or modify features at any time.

3. Account Requirements

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.
• Each account is for a single person. Sharing accounts is prohibited.
• You must notify us immediately at hello@itsnicolebrennan.com of any unauthorized use of your account.

4. Access and Payment

What you are buying

Access to NicoleAI is granted for a set period. That period is the one described to you when you bought it, or, if your access comes as part of a program you joined, it runs alongside your term in that program. Prices and access periods differ between offers, so the terms that apply to you are the ones you were shown at the time.

Payment

Payments are processed through our payment provider. You are charged once for the access period you bought. There is no recurring billing and no automatic renewal.

When your access ends

At the end of your access period you will no longer be able to sign in. This happens automatically. You are not charged again, and there is nothing you need to do. If you want to keep using NicoleAI after that, you can buy access again on whatever terms are being offered then.

5. Refund Policy

All purchases are final and fees are non-refundable, including if you stop using the Service before your access period ends.

• Exceptions may be granted at our sole discretion for technical errors or duplicate charges.

6. Intellectual Property

All content, trademarks, software, training data, prompts, frameworks, and materials associated with NicoleAI are owned by FREE YOUR MIND LLC or its licensors and are protected by U.S. and international intellectual property laws.

You may not:

• Copy, reproduce, republish, or redistribute any part of the Service
• Use the Service to train a competing AI model
• Reverse engineer, decompile, or attempt to extract the underlying prompts, embeddings, or training data
• Remove or alter any proprietary notices

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes while your subscription is active.

7. User Content

"User Content" means anything you submit to the Service, including chat messages, uploaded copy, saved prompts, and profile information.

• You retain ownership of your User Content.
• You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely for the purpose of operating and improving the Service.
• We may use aggregated, anonymized usage data to improve the Service.
• You represent that you have the right to submit your User Content and that it does not violate any third party's rights.

AI training: We do not use your User Content to train the underlying AI models. Your conversations, uploaded documents, saved copy, and profile information remain yours and are used solely to deliver and improve the Service for you.

8. Prohibited Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Harass, threaten, or harm another person
• Submit content that is illegal, defamatory, or infringes any third-party rights
• Generate or distribute malware, spam, or unsolicited commercial communications
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Scrape, crawl, or harvest data from the Service without written permission
• Use the Service to provide professional advice (medical, legal, financial, psychological) to third parties without proper credentials

9. Termination

Your access ends automatically at the end of your access period, as described in Section 4.

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NicoleAI is an AI coaching tool. It is not a substitute for licensed medical, mental health, legal, financial, or professional advice. You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FREE YOUR MIND LLC, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless FREE YOUR MIND LLC from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Travis County, Texas.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or prominent in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
